HC declares 15 per cent tax on private universities illegal
A High Court division bench comprising Justice Sheikh Hassan Arif and Justice Bhishmadev Chakrabortty passed the order after holding hearing on 46 writ petitions filed by different private universities including North South University, University of Asia Pacific and University of Liberal Arts.
“Though the second gazette supposed to reduce the rate of tax, it actually imposed tax on private medical, dental, engineering and information technology colleges. The court today declared those two gazettes illegal,” said Barrister Mohammad Sakhawat Hossain, who stood for the petitioners.
The court also asked National Board of Revenue (NBR) to return the money that had been collected as income tax from the universities under those gazettes. The gazettes were issued on 2007 and 2010 respectively.
