SC stays HC order declaring VAT on English medium school illegal
3 January 2017, Nirapad News: The Appellate Division of the Supreme Court today stayed a High Court order that had declared 7.5 percent value added tax (VAT) on tuition fee of English medium schools, illegal.
A four-member Appellate Division panel headed by Chief Justice Surendra Kumar Sinha passed the order and set January 29 for holding further hearing on the matter.
Earlier on December 12, 2016, a High Court division bench comprising Justice Zubayer Rahman Chowdhury and Justice Md Mozibur Rahman Miah passed that order while disposing of a rule issued earlier in this regard.
Following a writ petition filed by two guardians of English medium students, the High Court on September 17, 2015, had issued the rule upon the authorities concerned, asking them to explain in three weeks as to why their decision to impose 7.5 percent VAT on the tuition fee of the private university students, shall not be declared illegal.
